Warren Smith at World Magazine has recently published the following words:
... I’ve obtained a copy of the Mars Hill agreement, it covers both the employee and the employee’s spouse, and it threatens legal action if the employee has “any intentional or unintentional violation” of the agreement. Dave Kraft, a former elder who refused to sign the document and subsequently left the church, said, “It amounts to a gag order.”
There have been reports here and there that gag orders of some kind exist, enough reports to have sounded plausible even if no direct or indirect evidence was available. It looks like Warren Smith has gotten ahold of a copy of a Mars Hill agreement that covers an employee and the employee's spouse, threatening legal action if there are any intentional or unintentional violation" of the agreement, whatever the agreement might be.
If someone were to produce even a redacted copy of a non-disclosure or non-compete agreement that would be interesting, to say the least.

first anonymous, the usual procedure advisable here is to go find an old post (a couple of weeks old) and post a comment with your contact information, who you are, and it will go into moderation where it can then be read. You can get contacted eventually that way but things are busy around here and you'll need to be patient. Send along your contact info, who you are, via moderated comment, and you'll get contacted. If you're comfortable having it show up at this blog, that is. If you're not ready for that it's okay to wait.
If you like you can find a post tagged in the "where are they now" series on MH elders who had a role in the 2007 termination and trial process and put something in there. If you've got a non-compete and a non-disclosure both of those would be most interesting. Obviously redact them sufficiently so dead give aways of identity are not out and about.

I don't know how to prove this without giving away who I am, but this is a hoax.
While Kraft did leave because of some issues at MH, he called MH|HB and told him he never said what World magazine is claiming.
He was talking to someone and they took it out of context and told it to World magazine. Why do you think they haven't provided the NDA? I've asked myself the same question since I read it. When Kraft called and clarified, it made more sense.
While you may not have a reason to believe me, I would say, as someone who is seeking to be educated about MH and some of their issues, this specific claim leaves a burden of proof. Essentially, I would assume it isn't valid until proven true.
The only person who can legitimately clear things up about Dave Kraft at this point would be Dave Kraft. World Magazine may have been given information by a third party who misconstrued what was said or what documents were what but if Kraft doesn't say anything then he's entirely at the mercy of the news cycle and of whatever the BOAA may choose to say.
So, Kraft, if you're in a position to clarify on record what the deal is, it might be a good idea to clear things up, where ever you are.
World does have a burden of proof to confirm what these rumored gag orders are and what they look like. That said, the recent BOAA response seems to indicate that some non-disclosure agreements have existed and that the BOAA considers them appropriate. So, in a very limited sense, the question of whether NDAs even exist has been settled. They seem to exist by the account of the BOAA. Now it remains to be seen if World or someone else can show evidence of one.
